Child Accident Claims Case Study 1
Miss Y was 4 years old at the time of her accident. She had accompanied her parents, together with other children and their parents to a restaurant catering to the needs of parents and young children.
During the course of the visit Miss X had occasion to want to visit the toilet. The toilets were at the end of a corridor accessed through a further door. The door slammed shut onto Miss Y's finger causing a serious injury to her right index finger. Miss Y was taken to hospital and subsequently moved to a specialist unit. In due course her fingertip was amputated. However, Miss Y made a full recovery.
A Letter of Claim was sent to the restaurant owners asserting that they had breached the "duty of care" owed to children using their premises by failing to ensure that the doors are safe. Many other premises use mechanisms to prevent such doors from slamming shut. The restaurant owners accepted liability and as a result George Ide LLP were able to negotiate settlement of this claim. The sum of £7,500 was agreed. Because Miss Y was only 4 years old at the time of the incident the bulk of her claim (save that part paid for private medical care) has to be paid into the Court Funds office and then invested in the "special investment account" held by the Court until she reaches the age of 18.
Miss Y's parents said in a letter to George Ide LLP "...just a small note to say a very big thank you for the way you kept on persevering with this case. You have helped our daughter immensely with your efforts. You are a credit to your profession. My wife and I would not hesitate to recommend you to anyone".
