Claims Against The Police

Mr J was a man of "previous good character" - he had never been in trouble with the Police, however at approximately 2.00pm one Monday afternoon he was at home when there was a knock on the door. It was Police Officers from his local police station indicating that a warrant had been issued for his arrest by a Magistrates Court in the North of England some two years earlier. Mr M protested that he had never been to Wolverhampton and had certainly not been arrested there or required to attend Court. The Officers refused to listen.

Despite the fact that he was arrested at 2.00pm in the afternoon no attempts were made to transfer him the 150 miles from his home to the issuing Magistrates Court. The following morning the privatised prisoner escort service collected him for his onward journey to the Magistrates Court, despite his protests!

He did not arrive at the Magistrates Court until after 2.00pm the following day and by that time it appeared that the Magistrates had ceased sitting. Mr J was therefore detained in custody until the following day when it was eventually accepted by all concerned that he was not the same person featured in the Warrant. Not only did the person featured in the Warrant have a different date of birth, the name was spelt differently and the person sought was in fact black, whilst Mr J was white!

By the time he made the lengthy journey home he had been detained for in the region of 52 hours.

Mr J contacted Ian Oliver who is a specialist in claims against the Police. Letters to the Chief Constable of both relevant Police Forces resulted in them each blaming each other! This situation continued for a long period of time until finally, with the threat of issuing proceedings, both Police Forces agreed to share responsibility and to settle Mr J's claim. He received £7,000 in compensation and his costs were paid. He received 100% of his damages.
