CLAIMS AGAINST THE POLICE

Claims against the police

Specialists in actions against the Police

We have an established reputation in the field of actions against the Police. We represent clients for wrongful arrest, false imprisonment, malicious prosecution, assault and trespass.

We offer a free initial consultation at which we will advise on whether you have a good case and, if so, the necessary steps to take to proceed.

Who are we?

At George Ide LLP, our specialist team is headed by Ian Oliver, a partner with experience in civil actions against the Police.

How can we help you?

Even if you are unhappy with the way the Police have treated you, you do not automatically have a civil claim against them, or indeed grounds for a complaint. Police powers are both extensive and complete.

As specialists in dealing with complaints and civil actions against the Police, you can expect your representative at George Ide LLP to give you clear, concise advice and fight for your rights.

Areas of expertise

To sue the Police, your claim must come within a "cause of action". The main causes of action are set out below:

  • Assault
  • False Imprisonment/Wrongful Arrest
  • Malicious Prosecution
  • Trespass
  • Trespass to Goods
  • Negligence
  • Misfeasance in Public Office
  • Human Rights

We can also help with formulating and presenting complaints to the Police Complaints Authority.

What can you claim?

If you have a good claim, you will be entitled to "compensatory" damages and in some circumstances, depending on how the Police have acted, aggravated or exemplary damages. We can advise you on the level of compensation you could expect.

To help us with your claim, as soon as possible after the incident, you should write down exactly what happened in as much detail as you can remember. This should include names, dates, times and any other information you can recall. You should then contact us immediately. It is important to act quickly as there are various time limits. If claiming under the Human Rights Act your claim must be issued within one year. If your claim is negligence, within three years, and in most other cases, six years.

In some cases, we are able to settle claims without needing to go to Court. However, if necessary we will assist you in obtaining Public Funding - or in some instances a 'no win no fee' agreement - and prepare your case for you.

Whatever the situation, we can give you the very best advice and support, compassionately and in language you can understand.
