MOTORBIKE ACCIDENT CLAIMS

Motorcycle Accident Claims

It is an indisputable fact that if you are involved in an accident whilst riding a motorcycle (or as a passenger on a motorcycle) the chances are you will suffer a serious injury. In fact, research shows that upon average you are 16 times more likely to be killed or suffer a serious injury whilst riding a motorcycle than driving a car.

If you are involved in a motorcycle accident and suffered an injury you may be able to claim compensation. Given the statistics it is more likely that you will have suffered a serious injury, possibly a brain injury/head injury, a spinal injury, multiple fractures or even just a simple whiplash.

George Ide, Philips are one of the South's leading Personal Injury Solicitors (See Chambers UK Guide to the Legal Profession 2007)

What should I do if I have been involved in an accident?

  1. The law requires, if you are involved in an accident that you stop and exchange name, address and insurance details with the other parties.
  2. You should then prepare a detailed account of what happened including a sketch of the location and if possible photographs.
  3. You must ensure that you have the name and address of the other driver and any other witnesses.
  4. You must not admit liability (even if you think it is your fault) as this will place you in breach of your insurance contract.
  5. If you have been injured you must seek medical advice as soon as possible, with some injuries, particularly whiplash it may take time for symptoms to develop.
  6. You must notify your insurers.
  7. You must keep a record of your out of pocket expenses (as well as receipts).

What if the other party does not stop or is uninsured?

In the UK it is possible to claim compensation for injuries sustained even where the other party cannot be traced or is uninsured. Such claims are handled by a Government funded organization called The MIB (Motor Insurers Bureau).

Claims through the MIB are more complex than ordinary claims and special rules apply. Here at George Ide, Phillips we have many years experience in dealing with MIB claims and can lead you through this potential minefield. If you are involved in such an accident you must report it to the police as soon as possible or your claim will fail at this early stage.

How can I claim?

George Ide, Phillips Personal Injury Lawyers have been involved in motorcycle accident claims since the 1970's and have a wealth of experience. Now most claims are funded on a "...no win no fee" basis legally described as "Conditional Fee Agreement" (CFA). At the outset CFA's had a bad press with some unscrupulous operators exploiting claimants. We at George Ide, Phillips have an "ethical" policy and ensure that whether your claim is for a whiplash, broken bones, spinal injury or brain injury or other more serious injuries you make no payment of any sort and will receive 100% of your compensation if your claim in successful. If your claim is unsuccessful you will pay nothing and your opponent's costs will be covered by insurance.

We can access specialist barristers who are expert at presenting motorcycle accident claims. This is very important as sometimes assumptions can be made that motorcycle riders were for example travelling too quickly, when this was not the case. The presentation of your case deserves specialist attention to ensure that you can prove what actually happened.

What else can George Ide, Phillips do for me?

1. Physiotherapy

Injuries such as whiplash often benefit from early treatment by way of physiotherapy. We may be able to assist you in sourcing private physiotherapy on a credit basis. If no comparable service is available from the NHS in your area.

2. Private Medical Care

It may be that as a result of your accident you require some medical procedure in respect of which the NHS waiting list is lengthy. In certain circumstances it may be possible for us to assist you in obtaining such treatment on a private basis.

3. Motorcycle Hire

If your motorcycle was damaged or written off it may be some time before you are in a position to make alternative arrangements. We at George Ide, Phillips, in certain circumstances may be able to arrange for you to receive a bike on hire or loan.
