Uninsured Driver Case Study
Mr R was the driver of a motor vehicle that was emerging from a minor road onto a major road. Having ascertained that it was apparently safe to emerge, he began his manoeuvre only to be hit by a vehicle that was driving at an excessive speed along the minor road, disregarding entirely the blind summit that he was approaching. Unfortunately for Mr R it became apparent that the Defendant was in fact an uninsured driver. Mr R was, however, able to obtain his name and address and was put in contact with this firm. It became apparent, from the outset, that this claim would have to be pursued through the Motor Insurers' Bureau.
The Motor Insurers' Bureau is funded by insurers and is tasked by the Secretary of State to provide compensation, in certain circumstances, to persons suffering injury or damage as a result of the negligence of uninsured motorists. There are strict and complex procedures to follow if such a claim is to be successful. In this case contact was made with the Motor Insurers' Bureau and all procedures complied with. It became necessary to issue proceedings in the Court and the Defendant (assisted by the Motor Insurers' Bureau) asserted that Mr R contributed to the accident by pulling out in circumstances where he could not be entirely certain that it was safe. This was not an unreasonable argument and one that would have to have been considered by the Court. However, eventually it was agreed between the parties that this claim would be settled on a "50/50" split. This meant that Mr R received 50% of the value of his claim for personal injuries arising out of this accident. But for the availability of "Conditional Fee Agreements" (no win, no fee) and the Motor Insurers' Bureau, Mr R would not have been compensated.
